(The Beatles-Related) Original Affidavit Supporting a Trademark Application Registering the name "The Beatles" Signed By Brian Epstein (March 4th,1965). A real piece of Beatles history indeed. This is a three-page affidavit that would register the name "The Beatles." In this document Epstein declares that he is the managing director of NEMS Enterprises Limited, which is not authorized to do business in the United States. He goes on to explain that the present application is made to revive a prior application, that was denied by the patent office.Epstein states that as the manager and business director of the Beatles, he never intended to abandon or leave idle the previous application to trademark "The Beatles," but due to circumstances beyond control, including being unable to obtain signatures of the four Beatles, there were delays. He blamed their busy professional schedules, lengthy and continuous work as well as various illness and personal issues amongst the band members, that took much longer than anticipated.
Brian further explained that he thought all four Beatles had to be together to sign at the same time which was not the case. All of this prolonged the procedure beyond the time that was allowed to have the original application approved. He is requesting to resubmit and revive the Trademark application. Brian Epstein has signed in a ballpoint pen dated the 4th of March, 1965. His signature is being sworn before New York entertainment attorney Walter Hofer, who was hired by Capitol to represent Epstein and the Beatles.
The Trademark was granted and finally registered on September 7th, 1965. It's so fascinating to read a document such as this. So many manufacturers wanting to put the Beatles names on merchandise that Brian had to make sure he had trademark control in United States. This is your chance to own this original document. Wow!
